1. Ownership and Use of Site Materials

The “Copyrighted Materials” on this site: trademarks, service marks, logos, insignia, graphics, music, sounds, images, photographs, page headers, button icons, information, data and other elements and materials, including the design, look/feel and layout, are owned by and are the copyrighted works of JCCC or its third-party providers.

Copyrighted Materials may not be used, copied, reproduced, modified, made into derivative works, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including electronic, mechanical, photocopying, recording or other means, without the prior written permission of JCCC, its third party providers or as permitted by the fair use exception of the U.S. Copyright Act.

Prohibited conduct includes: i) use of the Copyrighted Materials in a way that constitutes libel, false advertising, copyright or trademark infringement, harassment, professional misconduct or a violation of privacy or other rights protected under the law; ii) unauthorized use of any Copyrighted Materials to promote products, causes or political candidates; and/or, iii) use that violates copyright, trademark, privacy, political activity or publicity/communications laws and regulations. The user assumes all risks of copyright infringement and/or violation of other federal and state laws, rules and regulations.

As a general rule, any permission granted to reproduce or use the Copyrighted Materials requires that user: i) not modify the Copyrighted Materials; ii) include any copyright notice originally included with such information; iii) credit the source; and, iv) include a disclaimer statement.

2. Online Conduct

You may not use the site for any unlawful purpose. You may not use the site to collect personal information about users or transmit through the site any unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful or any racially, ethnically or otherwise objectionable material of any kind, including any material that encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate applicable laws. You must comply with normal standards of ethical conduct and civility in the use of the site. You may not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity in your use of the site. You may not upload, post, email, transmit or otherwise make available any content or materials that infringe on any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. You may not upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation or attempt to make any commercial gain from your use of the site.

3. Links to Third-Party Sites

This site may contain links to websites controlled by parties other than JCCC. JCCC does not endorse or approve and is not responsible or liable for the contents or use of these third-party sites. JCCC is providing these links to you only as a convenience.

4. Disclaimer Respecting Site

Any opinions on the site are not necessarily those of JCCC. The site and materials are provided "as is," and the use of the site and materials is at your sole risk. JCCC makes no representations or warranties of any kind, express or implied, as to the site, its operation or the materials. JCCC hereby disclaims, to the fullest extent allowed by applicable law, all express or implied representations, warranties and guaranties, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement.

5. Limitation of Liability Respecting Site

Neither JCCC nor any of its affiliates shall be liable for any damages or any kind arising from or in connection with the use of the site or the materials, including mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses or delays in operation or transmission. In no event shall JCCC be liable for any indirect, punitive, special, incidental or consequential damages (including but not limited to damages for lost profits, loss or inaccuracy of data or loss of revenue). You agree to hold JCCC and its affiliates harmless from and indemnify them against any claims by you or third parties based on or related to your online actions or your use of the site or the materials and all damages, costs and expenses relating thereto.

6. Termination of Access

JCCC may cease operating the site or terminate your access to all or part of the site, without notice, at any time, for any reason.

7. Changes to Site or Terms of Use

JCCC may make improvements or changes to the site or to the services, programs or materials on this site at any time without notice. JCCC may revise these terms of use at any time, without prior notice, by posting the revision or the revised terms of use on the site; any revision is effective upon your access of this site.

8. Local Laws; Export Control

JCCC controls and operates this site from Administrative Computing Services and the Web Publishing office. JCCC makes no representation that the site or the materials are appropriate or available for use outside the USA. If you use this site from locations outside the USA, you are responsible for compliance with USA and foreign export and import laws and regulations and all applicable local laws. All marketing or promotional materials found on this site are directed solely to individuals and entities located in the USA.

9. Submissions

Except where expressly provided otherwise by JCCC, all comments, questions, feedback, information or other materials you submit to JCCC through or in connection with this site ("Submissions") shall be considered non-confidential and JCCC's property. By providing such submissions to JCCC, you assign to JCCC, at no charge, all worldwide rights, title and interest in and to the submissions, including all copyrights and other intellectual property rights. JCCC shall be free to use and/or disseminate such submissions on an unrestricted basis for any purpose. You acknowledge that you, not JCCC, have full responsibility for the submissions, including their accuracy, legality, reliability, appropriateness, originality and copyright.

10. Rights and Remedies of JCCC

You agree that JCCC shall have all rights and remedies provided under these terms of use under applicable law.

11. Governing Law; Choice of Forum

These terms of use, the use of the site will be governed by and construed and enforced under the laws of the state of Kansas (excluding any conflict of laws rules). These terms of use represent the entire understanding relating to the use of the site and prevail over any prior or contemporaneous, conflicting or additional, communications. The exclusive jurisdiction and venue for any legal proceedings relating to these terms of use or to the site or transactions or activity conducted on or relating to the site will be the appropriate state or federal courts in Johnson County, Kansas; you consent to such jurisdiction and waive all objections to such courts based on jurisdiction, venue and inconvenience of the forum.
