Copyright Infringement Plan
Higher Education Opportunity Act (HEOA) of 2008
34 CFR 66814.(b)(30) Effective July 1, 2010
In order to participate in any Title IV, HEA program; institutions must implement a written plan to effectively combat the unauthorized distribution of copyrighted material by users of the institutions' network without unduly interfering with the educational and research use of the network. The plan must include:
Use of one or more technology based deterrents
JCCC blocks all downloading from known peer-to-peer file sharing sites. In addition, the following message is displayed on the login screen for wireless internet access:

Warning: If you continue to logon using this web page, you will be logging on to an unencrypted wireless network. Attackers/hackers can capture your network traffic on this unencrypted network. All filesharing programs such as Kazaa, Limewire, Morpheus, Gnutella, etc. are prohibited if you have any such programs, you must remove them. If abuse of the network is detected your access will be disabled. See JCCC Student Code of Conduct.
Mechanisms for informing the community about appropriate versus inappropriate use of copyrighted material, including the required consumer information disclosure required by law
JCCC publishes on the website information about the appropriate use of copyrighted materials.
Procedures for handling unauthorized distribution of copyrighted material, including disciplinary procedures
Section 5(g) of the JCCC Student Code of Conduct (Board Policy 319.01) states:
Computer/Campus Computing Systems - No student shall engage in the following... The use of group web sites for the publication or distribution of copyrighted materials or licensed software.
The Code of Conduct also states that violations can result in sanctions including but not limited to warning, probation, interim suspension, suspension, or expulsion.
Procedures for periodically reviewing the effectiveness of the plans, using relevant assessment criteria
Information Services monitors network traffic types and would block content as appropriate.
Each year Financial Aid will update the Student Consumer Disclosure website, reviewing requirements and consulting with other college departments as needed to ensure the proper mechanisms are in place.
The institution shall, to the extent practicable, offer legal alternatives for downloading or otherwise acquiring copyrighted material
JCCC allows unrestricted access to the web, but blocks known illegal peer-to-peer sites. JCCC students, faculty, and staff can access legal sites to acquire copyrighted material as needed.
